There are a number of places that were established before the smoking ban that have remained open. A stipulation was created in legislation allowing them to stay open if they could document a 10% loss in revenue over 30 days after the smoking ban came into effect. This would not help a new establishment. The only solution I have come up with is to form a private club. The legislation states that private clubs are exempt unless they have employees. Only way around this that I can come up with is to create an LLC and offer people the opportunity to buy into the company and receive a share/dividend in return (instead of a salary from working at the location). Anyone done this?Really just trying to build a fun place to work, where people can come hangout, watch movies and chat with friends.
