wisp Posted December 7, 2007 Share Posted December 7, 2007 A few weeks ago my friend and I were smoking hookah in the park, and somebody called the cops and said we were "smoking dope out of a bong." When they showed up they immediately recognized that it was a hookah. They gave us the expected questions (what are you smoking with that, how old are you) but then they told us that we had to leave because we "weren't allowed to do that here." We didn't want to question them so we left, but for future reference can they really do that? Shouldn't you be allowed to smoke hookah anywhere you can smoke tobacco? May have know you were not doing anything wrong, but asked you to leave so they dont get called out there all the time or people dont get all crazy and shit. EternalSoil Posted December 8, 2007 Share Posted December 8, 2007 if you are not breaking the law though then they are at fault. some cops are cooler than others, maybe next time you could talk to the cop a bit and he might be cool with it. essentially legality wise, if you could smoke a cigarette there, you could smoke a hookah. less mess too unless you throw foil and shit around or break your vase. Their squad car has a camera that they're not allowed to tamper with and they have a microphone on them at all times that they must keep on. They have these things to protect themselves as much as to protect you. If you didn't do anything wrong and they were dicks and did something to you without any probably cause (must be be substantiated evidence, probable cause can't just be a 'feeling') you can file an official complaint with Internal Affairs and they carry out an investigation. Only had cops called on me in the park once granted it was about 2 AM was kicked out because the park was closed. Don't remember who said that nor in what language, but a rough translation would read "Give me a man and I'll find a clause".Here in Quebec it's ok-la... A kid tried to steal my hookah last week and broke it. One of my friends that was there is a criminal justice major and knows all the policemen in the area. He pretty much told me that he had talked to the cops about what they would do to someone with a hookah in this town, another friend besides me owns one, and he guaranteed they would bust me for "paraphanalia." I know that the cops were probably wrong but I did not want to put up with the headache of cops in a small town. So maybe they didn't care b/c we weren't making a scene, so no reason to even be really questioned. The old guy asked what it was over and over, and I kept saying "pumpkin pie" and "tropical revenge" over and over again, like he really didn't believe me...so I let him try and he couldn't handle it (ciggarette smoker too) Link to comment Share on other sites More sharing options...

Can you afford to be in the right while siiting in a cell or in court waiting to get the case thrown out? After explaining (not arguing) to the cop that you are doing nothing illegal, if he still tells you to go, I would go. Straight home to look up local statutes, info on hookahs, and maybe check with the local police station to see what specific laws are involved. Get the name of the officer you speak to. If everything checks out, print out all the relevant info, and set up in the same place the next day, and wait. Might be even safer to set up, but not light it. Be respectful and don't give the guy a reason to escalate the situation.You may have to bring the documentation with you for a few more trips, until you cycle through all the officers in the area, but after a couple of times, you get pretty good at it, and it goes a lot smoother.Like it or not, its all about playing their game... Child friendly areas - beaches, parks, etc., are generally tobacco free zones by local law and honestly I've never been able to come up with a convincing argument to justify smoking in a area normally packed with kids. dude3516 Posted December 8, 2007 Share Posted December 8, 2007 A few places outright ban smoking in public parks to reduce exposure to children and such give a lookup to the laws in your area, but if a cop asks you to do something it's best to just go with it, assuming that it isn't a major infraction on your rights. Cops probably could bust you for it and give you a paraphenalia ticket, then test it to find there is no drug residues where the case would be overturned. Good luck getting your hookah back though. Cheese// Posted December 8, 2007 Share Posted December 8, 2007 I'd rather just do whatever the cop says, as long as his request isn't too crazy, than waste hours trying to prove myself right.Especially with the South African justice system I know that I can't really win.But I more commonly get trouble from people who own whatever private property I smoke on (restaurants, private parks etc.) and you can't really argue with them if they tell you to leave. For example, unless they have warrent or provable, objective cause to search your trunk or bag or whatever, all they can do is suggest that you let them take a look.
