Un-fucking-believable

I've got to vent about this because it is easily the most rediculous set of circumstances I've come under thanks to internet shopping.

So it all started when I wanted to purchase Fallout 2 for Mac OSX. I found it on Amazon.com for $19.99 new from the seller ubbergames.com. I placed the order, but immediately after I realized that the shipping address on my Amazon account is a university mailbox that is no longer under my name. So, I sent ubbergames an email through Amazon telling them my home address and explained that I had to have the game delivered there. They replied to my email the next day saying simply "ok". Well, the package was supposed to arrive sometime between January 9-23. On January 28, still no package, so I emailed them asking what happened. They claim it was delivered January 7 to my university mailbox. I reminded them of my previous email regarding the alternate shipping address and they, despite having replied to that email, claim to have "overlooked" it. So I go to the university box office and they told me that because the name on the package did not match the name on the mailbox, they sent it back. I send another email to ubbergames telling them this and they replied stating that they checked with their postmaster and assured me that the package is NOT coming back to them. So I go to the post office and have them look up the tracking number. According to the USPS, my package DID in fact get returned to Plano, TX, where ubbergames is located. I told them this and asked them to either mail it again to the correct address or refund my money. I also went on Amazon and left feedback explaining how I was lied to twice and still didnt receive my package nearly a month after placing the order. Today I got an email from ubbergames saying that they won't refund my money unless I remove the feedback! How fucking absurd is that!? Now, because they got their feelings hurt because I don't want to see another customer get fucked over like I did, I'm out a game and $20.

1. Contact your bank that the transaction occured through. Show them complete documentation...emails and the info from the postal carrier. Tell them you want them to cancel/get your money back. Bonus if its visa, visa always refunds on terms like these.
2. Post about them on all gaming sites you can think of.
3. BBB
4. Threaten legal action. If they go on about you "slandering them", tell them its not slander if its true and that you'll see them on Judge Judy.

if all else fails, fly out to where they are located and key some cars. Takes care of your financial investment(cash on game and ticket) with the damage to cars lol_hitting.gif

Once you remove it you can't post new feedback.

I would tell them it was 100% their screw up, and once it arrives you will remove posting.
then I would contact amazon c-service and tell them the vendor screwed up, and is now threatening to keep the product they have now admitted to having if you don't remove feedback left in an honest attempt to be truthful. Use words like "blackmail", and "extort a positive rating". Amazon usually fixes that stupidity pretty fast. It is against Amazon's rules for them to try to pressure you into removing a negative. If they sent that in an email, that needs to get forwarded to Amazon.
Here is the rules & regs I received from Amazon when I signed up as a vendor: (underline is mine)

How do I remove a negative feedback?
Ask the buyer to remove the feedback: If you want to respond to negative feedback, the best option is to work with the buyer to improve the situation that led to the negative feedback. Then, ask the buyer to remove the feedback. To do this, e-mail the buyer with concern over the problem, and remedy it if possible. If you develop a positive relationship, ask the buyer to remove the feedback. Instructions on how to remove feedback can be found on our buyer Help page, Leaving Feedback. When contacting a buyer, always keep in mind that pressuring a buyer is unacceptable and a violation of our Community Rules. Feedback removal is not available for Auctions transactions.

Next course of action is to follow up with a complaint to the Postmaster General's office. (get a card from USPO) By the time you are done with those, even if you don't have your game, you will definitely have caused them more than $20. worth of headache.

BBB can't do a damn thing if a biz decides to ignore them. Edited by TheScotsman

you could always remove the feedback and tell them to send it then give them even worse feedback than before becaus ethey are blackmailing you and then send bbb and amazon both letters on what they did to you, even though its only twenty bucks other people could be getting the same treatment as they did you.

Ubbergames is now filing for mail fraud against me! They claim I have their game, which I don't, and sent me an email calling me a thief. I have a print out I got from the post office showing that the last movement for my package's tracking number was delivery to Plano, Texas. I'm going to fax the print out to them so they'll cancel the claim. This fucking tears it. I'm not a thief, I would not spend a month sending emails to a company to fuck them out of a $20 computer game that came out in the 90s. This is absurd, and I want to know if there's anything I can do to these assholes for their false accusation.

If you REALLY want to kick them in the bollocks.

As you purchased through Amazon (i think)... Write a letter.
Yes. A Letter of complaint.

No swearing, proper English, sentences, grammar ect ect.

Then post it, registered mail, to the CEO and Company sectary of Amazon,

Ensure that you point out the history, the problems and what you want him to-do about it. Ensure that any further action is pointed out in the letter and the time scales that you intend to take that further action. 2-4 weeks is reasonable.

Then see what happens. It has worked very well for me in the past.

You could also write to the company accusing you theft and tell them you have formally written to the CEO of Amazon and that you will enter into further correspondent once he has had time to investigate your complaint.

If you approach this like an adult and do it properly this can, and should, be resolved.

Thanks JD, i think that's the best course of action. I'll keep you guys posted and see if I can't put a hurtin' on these whackos.

I should point out that you need to find the names of the people you write too. And address the letters and envelope accordingly.

If it goes to court, take ALL documentation, print out emails etc...
but make sure it goes to Judge Judy lol, she'll tear those assholes new ones.

100% Agree r1. Very sage council right there.

Okay, so I sent proof of my innocence and received this from ubbergames:

"We appologize for the accusatory comments that you got yesterday from our employee yesterday. We have never treated any of our past customers (happy or not) like this. Like our listings indicate...all items come with a 100% satisfaction guarantee.

We hope that you accept our company's apology for the behavior of someone no longer associated with us. If you ever have any questions or comments, feel free to contact us via email or phone. Thanks so much for your patience."

Apparently the guy who called me a thief and a liar got fired. I don't think I'm satisfied with that. You guys think I should still follow through with a formal complaint to Amazon.com to get these guys removed?

Well - that's down to you.

Do you want togo through the hassle? The company looks like they have accepted this was unacceptable and have taken appropriate actions.

If your going to get your money back then I think I'd be inclined to leave it. But I'm British.... we don't complain about anything tongue.gif

I disagree JD, they have yet to take appropriate actions. In my opinion they should have taken the loss and sent him the game as well, because all they did was give him a huge hassle and then put him back to square 1. I also disagree with your last comment, as I have dated British girls in the past and they complain about EVERYTHING.

If you want to get info for who to contact at Amazon (complete with phone numbers, addresses, etc), I suggest seeking help at Consumerist.com. If you can't find that info by searching their articles, e-mail them at tips@consumerist.com and they'll do what they can to get you the information you need, or perhaps some advice as to how to approach it.

I wouldn't fully believe it, I'd want names... lots of times companies just say things to shut someone up. I bet he's still sitting behind a desk, or it was the same person handling, emailing this to you.
You went through a lot of hastle, and in my experience with companies, you should at least get a coupon.

Meh, next time just download it from the internet. You'll save $20, a lot of nerves, and will actually do Planet Earth a small service by not having a small parcel being droven around in circles.
