Plus, the 16th amendment made it clear that the government can tax income. So even if you interpret the original document as saying taxes are unconstitutional, well the document has been changed. Unless, you take the absurd stance that a 200 year old document should have no means of alteration. I’m not particularly fond of our government, but realize the necessity of taxation. For instance, I go to a public university CU Boulder, which allows me to pay far less in tuition. Education benefits all and should be assured by the government. A better educated society will simply be more successful. Look at Sweden where there are essentially only degrees of middle class life. They pay excessive taxes. However, the benefit increases many fold. They have one of the highest life expectancies, and the best overall quality of life. Of course, our country is far less efficient, and squanders much of its money. I would still contend that through public education, poverty aid and other initiatives the net effect of the money is good. In any case, even without the amendment you would be taxed in a similar manner. The states would merely have more control in determining your fate. The Congress shall have power To lay and collect Taxes, Duties, Imposts and Excises [ . . . ] but all Duties, Imposts and Excises shall be uniform throughout the United States [ . . . ] Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers [ . . . . ] No Capitation, or other direct, Tax shall be laid, unless in proportion to the Census or Enumeration herein before directed to be takenIt essentially states you can extract a direct tax from the states according to their population. That's rather indirect, but certainly allowed for some sort of taxation of individuals. However, it appears it would be originally up to the states to determine the mode of taxation. Instead of a federal tax, the government would demand money from individual states, which would than probably tax your income. So either way it doesn't really matter. We have schooling, labor protection, child services, discrimination protection etc. Ultimately, the average person’s life was much worse before the expansion of government protection. The burden of proof would be on the state in question or the feds. For that burden, they have to solicit the internet service provider. I’m not factoring in the possible pain caused to Indians the Mexicans etc. Those actions have little bearing on what I was discussing.
