Laws Relating To Hookah Lounges

Recommended Posts

Hey y'all,
So, firstly, I just wanted to say hello. This is my first post here! Good to be here.

A few things.
I went to a hookah lounge in NYC. They only served SOEX, with the idea that 'no tobacco products can be smoked in bars' in NYC. That got my friend who I was with pretty angry, but that passed. I've heard that some places make some a 'club', that is like cigar clubs. Any thoughts?

Beyond this, most of the government agencies that would regulate hookah bars are the various health departments, no? What kind of 'law' or 'regulation' should be looked for? (I think I have something found online, but not sure
http://www.monroecounty.gov/p/eh-SmokeFreePublicPlaces.pdf

this is for NYC I imagine. Look at the 'free from restrictions part', thats how I came up with cigar clubs)

And anything else people could enligthen me about the law aspect would be awesome.

ya the smoking ban sucks, it should take effect nationwide. within 10 years i guess there will be no hookah or cigar bars. at least according to CNN. also this section is for how-to stuff, but since you are new it should be no big deal, they will move it. welcome to the forum and have fun. also check out the rules, i would hate to see a new guy get banned. wink.gif

I wouldn't worry too much about me being banned. I'm pretty well used to the rules of forums (at least, political debate forums, where things can usually get a lot more heated than over hookah).

I put this in the 'how to' place because I thought it was 'how to understand the laws for hookah lounges'.
What about 'cigar clubs' used for hookah club?

The way I understand it, the law differentiates between a bar and a smoking lounge, at least in most cases. Smoking lounges will still be able to exist, as long as they don't do certain things. Like, for example, one hookah lounge near me had to stop having live music, because that classified it as a bar. Serving food or drinks may be prohibited as well.

Also, I've heard that existing smoking lounges can be 'grandfathered in'. Basically, what that means is that if you can show that a regulation like a smoking ban would be adverse for your business, you can be exempt from it. This only applies to existing businesses, though, not ones created after the regulation is in place.

I'm not a legal expert, but this is what I've heard.
