I see why you can't make it an outdoor bar at your current location, didn't realize you were part of a strip. Maybe if you moved your business to a new location you could? But, in order to smoke anything it has to be a free standing building meaning his is the only business/home on the property. You might try to check with the landlord to see if they have an free standing property's you can move to, sometimes landlords will simply allow you to move and take on the new property in the lease. Problem, it'd probably be more expensive.I've seen some hookah bars, namely Howards Hollywood Hangout in palm desert, sell cigars and hookah. Then theres the problem of investing in a humidifier and cigars. I know of some cigar manufactures though that will name your own cigar brand. This exemption applies only to the actor or performer portraying the use of tobacco products during the production. Here are a few places that stick out that may be a loop hole:( Smoking may be permitted in the following places:(1) A private residence. *is there any way to make your bar a private residence that just happens to charge people so smoke? lets say I own a house, a friend comes over, I say "for $10, I'll light up my hookah and we can smoke. Maybe?(3) A tobacco shop if smoke from the business does not migrate into an enclosed area where smoking is prohibited pursuant to this Article. A tobacco shop that begins operation after July 1, 2009, may only allow smoking if it is located in a freestanding structure occupied solely by the tobacco shop and smoke from the shop does not migrate into an enclosed area where smoking is prohibited pursuant to this Article. *Maybe you could claim to be a tobacco shop that lets the customers try out the product before buying. Just make sure the smoke doesn't "migrate" to your neighbors. Might try to get a freestanding structure as indicated by someone else. Not really sure what the July 1, 2009 date means, if anything.All of the premises, facilities, and vehicles owned, operated, or leased by any tobacco products processor or manufacturer, or any tobacco leaf grower, processor, or dealer. *talk to Eric and see how to make your own baccy. Turn your shop into a manufacture who happens to let customers try the product. Maybe see what it would take to become a "dealer"Something else I noticed concerning the penalties for disobeying the law:Continuing to smoke in a nonsmoking area described in this Part following oral or written notice by the person in charge of the area or the person's designee constitutes aninfraction, and the person committing the infraction may be punished by a fine of not more thanfifty dollars ($50.00). *figure out if this $50 is a one time thing or a reoccurring fine, if it is a one time thing, just explain to your customers they will be fined $50, call it a "general fee" colleges love billing us "general fees" when they run out of excuses for wanting our money. It says that they will enforce your lounge with a "health director" but it doesn't really say what he or she will actually do.Really, I think considering yourself a tobacco shop rather than a lounge will be your best bet. It specifically states that a tobacco shop is legal as long as the smoke doesn't migrate to other establishments. The major kicker is that you can only make 25% of your total revenues from smoking. BUT, I think what you COULD do is tell your customers you will "sell" them the baccy, making it part of your tobacco shop revenue, and then offer to let them use your hookah to smoke it. You may want to consider charging a bit more for the baccy to cover the cost of them using your hookah, or just charge a minimal fee to use your hookahs, making sure it stays less that 25% of your revenues. Selling hookahs and accessories will also help. The only other bad part is that you would have to stop serving food and alcohol, if you even do in the first place. Ya, it would suck a bit, but at least you could keep your doors open.Hopefully my ideas are someone logic and not just a bunch of bullshit. Now I am really understanding why it will be very hard to make an outdoor bar and why you can't convert your's into one. Definition of an enclosed area per the article: "Enclosed area". – "An area with a roof or other overhead covering of any kind and walls or side coverings of any kind, regardless of the presence of openings for ingress and egress, on all sides or on all sides but one. According to the Bill, the definition of smoking is: "Smoking". – The use or possession of a lighted cigarette, lighted cigar, lighted pipe, or any other lighted tobacco product. The coal is technically the only thing that gets lit, some people don't even light the coals, they just warm them up. There is nothing in that definition against warming up tobacco to inhale.
