He really doesn't even have to start making his own baccy, all he as to do is start selling baccy and make sure his revenue from his baccy is at least 70% of his total revenue, which shouldn't be hard. The only hard part would be to quit serving alcohol and food.

I think that if mush did not serve alcohol anymore it would greatly decrease his business as he is prob the only hookah bar in his area that is an actual bar as well. It is unique and in the video I believe he stated that kids who are underage can hang out while their overage friends drink and everyone smokes and has a good time.

I don't know Mush I hope this turns out in your favor but in my opinion there should be a grandfather clause because without one it is just saying F**k you to the business that opened before our rights were slowly taken away.

If we choose to go to a place where we will knowingly inhale smoke than that is our right.

Agreed, it would suck, but if the difference it between being open or not being open, sometimes you have to make sacrifices, even if they suck.

Fight it mush, fight it to the bitter, bitter end. I hope the politicians enacting all these bans go down next election cycle. Start a general petition among yourself and other businesses like yours. Argue from the taxation perspective. Anything you can do to plant a seed of doubt in their minds, do it. Slippery slope is a good argument. It starts with restaurants, tobacco shops and hookah bars and eventually it will get to cigar bars, the very places they frequent. Its just a matter of time.

*talk to Eric and see how to make your own baccy. Turn your shop into a manufacture who happens to let customers try the product. Maybe see what it would take to become a "dealer"

Something else I noticed concerning the penalties for disobeying the law:
Continuing to smoke in a nonsmoking area described in this Part following oral or
written notice by the person in charge of the area or the person's designee constitutes an
infraction, and the person committing the infraction may be punished by a fine of not more than
fifty dollars ($50.00).
*figure out if this $50 is a one time thing or a reoccurring fine, if it is a one time thing, just explain to your customers they will be fined $50, call it a "general fee" colleges love billing us "general fees" when they run out of excuses for wanting our money. It says that they will enforce your lounge with a "health director" but it doesn't really say what he or she will actually do.


Really, I think considering yourself a tobacco shop rather than a lounge will be your best bet. It specifically states that a tobacco shop is legal as long as the smoke doesn't migrate to other establishments. The major kicker is that you can only make 25% of your total revenues from smoking. BUT, I think what you COULD do is tell your customers you will "sell" them the baccy, making it part of your tobacco shop revenue, and then offer to let them use your hookah to smoke it. You may want to consider charging a bit more for the baccy to cover the cost of them using your hookah, or just charge a minimal fee to use your hookahs, making sure it stays less that 25% of your revenues. Selling hookahs and accessories will also help. The only other bad part is that you would have to stop serving food and alcohol, if you even do in the first place. Ya, it would suck a bit, but at least you could keep your doors open.

Hopefully my ideas are someone logic and not just a bunch of bullshit. Now I am really understanding why it will be very hard to make an outdoor bar and why you can't convert your's into one. Definition of an enclosed area per the article: "Enclosed area". – "An area with a roof or other overhead covering of any
kind and walls or side coverings of any kind, regardless of the presence of
openings for ingress and egress, on all sides or on all sides but one. " So basically you can't have any walls.

No, any idea is worth listening to. But I need the booze revenue to stay open in this town and I just don't want to have to play stupid games like other folks in LV. Either i will be open or closed, but im going to do it all above board and legally. Even if we are going to end up in court I have a feeling arguing the definition of "smoking".

Thats the lying bitch that said for 6 weeks she was working on an amendment for me, then when it was out of the senate admitted she hadnt tried because the sponsor of the bill asked her not to.

You need to get some publicity - find out who's going to run against her and set up some support rallies at the bar!

Start letting the media know that apparently your local representatives do not believe in supporting local small businesses and are only doing favors for their friends in congress.

Yes, the only way this is going to get changed is to rub it in everyone's faces, and let them know what is happening. Don't make the focus about being a hookah bar, but a local business that is being shut down by bad legislation. Anyone have any connections in the news?

Oh, and and on a side note. -5 internets for extreme amounts of starbuzz containers in your bar!!!! wink.gif Edited by Barnaby

we're gettign more and more interest from the media. A local new radio station interviewed me for a series they are doing on the effects of the upcoming ban, the local town paper for the little burb connected to chapel hill called and interviewed me over the phone. And some of the hookah bars that ignored my calls for help before thhe bill passed are now calling in a panic asking what to do. Schmucks.

and just cause I carry soemthing, doesn't mean i SMOKE that soemthing. It sells almost as well as the Tangiers, of which I carry twice the selection. smile.gif

Mush - seriously - now's the time....


Organize a PUBLIC "smoke-in". See if you can get a permit for a large open park of some sorts and advertise the crap out of it, get tons of people. Invite the media. Invite the whore of a representative AND her competition.

Invite the HookahForum...I bet camel and I could make it down for that, and I be there are others that would as well.
