I don't think he's spamming, just because he hasnt pushed the website to the forum whatsoever. The survey he was trying to link was to help him better his website, but probably did not link directly to it.
But from an email standpoint, if you hadn't registered to receive anything from them, the it's considered spam.
But so far it hasn't been linked that I know of to the forum, I'd let it slide. Thats just me though, those green people may have a different opinion.
