Well This Is Crap, Anyone Who Moves Should Be Aware Of This

so I just saw on the news the other day Good ol' California passed a bill banning smoking in Condo's and apts. They have a grandfather part though if your lease was signed before Jan 1 2012 then I think you have to be notified if the landlord wants to add it to your lease. I think you have a year before they can add it. Anyhow this is complete shit because i just moved and I'm going to be signing a new lease in the next day or two. The thing I can't tell is if it is just left up to the landlord to ban or allow smoking or is it banned by California law no matter what..? anybody know? Found a .pdf file but the lawyer talk confuses me. and yes it bans all tobacco products.

This isnt a huge deal. I moved out when i was 18 and in that span i have lived in 10 different apartments. 5 of those as a hookah smoker but all 10 of them were no smoking apartments which almost all apartments are. It comes with the territory of living in a place that isnt yours. That being said i have never let it stop me and dont plan on it. I have renters insurance and if i burn the carpet thats why you put down a security deposit. Ill smoke if i damn well want to. Just gotta be careful about it.

Also highly doubt it will be fully against the law. If a landlord says you can smoke in a unit(95% of the time its gonna be no anyways) i dont think the government can stick their nose into telling tax paying americans what they can and cant do in the home they own.

It's unenforceable most likely but then lots of laws on the books are. The biggest problem is that we have a pretty good sized group of anti-smoking Nazi's in California who are trying to outlaw it altogether in baby steps. "SmokeFreeCA" does more damage to our smoking rights than anything else out here. One of the reasons I'm hoping to move to the Pacific Northwest.

I'm not sure where the confusion lies. It's black & white in the first block of text:

"This bill would authorize a landlord of a residential dwelling unit to
prohibit the smoking of tobacco products on the property, in a dwelling unit,
in another interior or exterior area, or on the premises on which the dwelling
unit is located."

There's a statement saying that if you've entered your lease prior to 1 Jan 12, the landlord has to change your leasing agreement. No grandfathering apparently.

well i'm just an idiot, I do think I remember many places banning it long before this new law. But now it is just gaining more power becuase of that stupid tobaccofreeCa like Rani mentioned. I just don't want to get evicted over this

How often does your landlord come into your apartment? Mine never does, and whenever I schedule to have maintenance come in to fix something, I make sure to put all my stuff away. I can smoke in my apt, so why do I do this? I don't want them to know what made the couple of burns in the carpet (which I cleaned up VERY well, so that now it isn't really even that noticeable), and so that way I can just say it was there already when I moved in to get my deposit back. They can't question me, because the carpet WAS in fact pretty messed up when I moved in. That works out in my favor, because now whenever a tenant moves out, they totally replace the carpet and everything.

EDIT: I agree with Jay's interpretation of it. Sounds right.

if you can't move it just snag a cheap but decent looking wardrobe (i got one at ikea for like $50 on sale...which they run all the time) it's pretty convenient, actually. the dowel for coat hangers serves nicely as a place to drape your hoses over, the bottom shelf (basically on the floor) is a great place to put your pipes, the top shelf can be used to store extra bowls, your baccy, coals, and coil stove (if applicable) and you can screw an eye-hook in the side of the wall of the thing to hang your cleaning brushes from. it's super-convenient and tidy, as well as a way to have your stuff basically out in the open, but put away at the same time.

I live in california and id ont care plus i know the owner of the building would careless but i mean maybe if the landlord where u are staying would walk by and smell it they might not like it but if u were to smoke outside that shoulnd't mater
